LabsLedger Terms of Use

PLEASE READ THESE TERMS CAREFULLY BEFORE USING LABSLEDGER.

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and SierraNova Labs LLC, a California limited liability company ("SierraNova Labs," "we," "us," or "our"), governing your use of the LabsLedger software application ("App" or "Software").

BY CLICKING "I AGREE," DOWNLOADING, INSTALLING, OR USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.

1. Privacy First: Your Data Stays Yours

1.1 Complete Data Privacy

SierraNova Labs has designed LabsLedger with your privacy as the highest priority. We want you to understand exactly how your data is handled:

We NEVER have access to your data. Your health information, lab results, PDFs, and all personal data are stored exclusively on your device or in your personal iCloud account.
We NEVER transmit your data to our servers. SierraNova Labs does not operate servers that collect, store, or process your personal health information.
We CANNOT see, access, or retrieve your data. Even if requested by you or required by law, we have no technical ability to access your data because we never possess it.
We do NOT collect analytics or usage data. The App does not phone home, track your usage, or report any information to us.

1.2 Data Storage Locations

Your data is stored in one of two locations, chosen by you:

Local Storage ("This Mac Only"): Data is stored in the App's sandboxed container on your Mac.
iCloud Storage: Data is stored in your personal Apple iCloud account, managed by Apple Inc. under Apple's privacy policy.

1.3 No Data Recovery Capability

IMPORTANT: Because we never have access to your data, we cannot help you recover lost data under any circumstances. If you lose your device, delete the App, or experience data loss, we cannot restore your information. See Section 5 for your data backup responsibilities.

2. Eligibility and Account

2.1 Age Requirement

You must be at least eighteen (18) years of age to use this App. By using the App, you represent and warrant that you are at least 18 years old.

2.2 Accuracy of Information

You are solely responsible for the accuracy of any information you enter into the App, including but not limited to lab results, biomarker values, reference ranges, and personal health information.

3. Not Medical Advice — Critical Disclaimers

3.1 No Medical Advice

LABSLEDGER IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE.

The App is a personal health information organizer designed to help you track and visualize your lab results over time. The App:

Is NOT intended to diagnose, treat, cure, or prevent any disease or medical condition
Is NOT a substitute for professional medical advice, diagnosis, or treatment
Is NOT designed or intended for use in medical emergencies
Does NOT provide recommendations for medical treatment or lifestyle changes
Is NOT approved, cleared, or registered by the U.S. Food and Drug Administration (FDA) or any other regulatory body

3.2 Not a Medical Device

LabsLedger is a general wellness and personal health record management application. It is NOT a Class I, II, or III medical device under FDA regulations, is NOT subject to FDA premarket review or clearance, is NOT compliant with FDA Quality System Regulations for medical devices, and is NOT FCC approved as a medical device.

3.3 Reference Range Disclaimer

CRITICAL WARNING: The reference ranges displayed in this App are general guidelines compiled from publicly available sources. They may NOT reflect current medical standards, may NOT be appropriate for your age, sex, medical history, or specific circumstances, and may contain errors or outdated information. YOU SHOULD NEVER rely solely on the App's reference ranges or status indicators to make decisions about your health.

3.4 Consult Your Healthcare Provider

ALWAYS seek the advice of your physician or other qualified healthcare provider with any questions you may have regarding a medical condition, lab results, or treatment options.

3.5 Software May Contain Errors

Like all software, LabsLedger may contain bugs, errors, or defects. You acknowledge that the Software is provided "as is" and may not be error-free.

4. License and Intellectual Property

4.1 License Grant

Subject to your compliance with these Terms, SierraNova Labs grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices that you own or control, solely for your personal, non-commercial use.

4.2 License Restrictions

You may NOT: copy, modify, or distribute the App; reverse engineer, decompile, or disassemble the App; remove proprietary notices; use the App commercially without authorization; sublicense, rent, lease, or lend the App; use the App in violation of applicable laws; or circumvent the App's licensing or copy protection mechanisms.

4.3 Intellectual Property

The App, including all content, features, functionality, design, code, and documentation, is owned by SierraNova Labs LLC and is protected by United States and international intellectual property laws.

5. Your Responsibilities

5.1 Data Backup Responsibility

YOU ARE SOLELY RESPONSIBLE FOR BACKING UP YOUR DATA. Because SierraNova Labs does not have access to your data, we cannot recover lost or deleted data, provide data restoration services, or access your backups on your behalf.

5.2 Security Responsibility

You are responsible for maintaining the security of your device and accounts, using strong passwords, protecting your backup files, and keeping your software updated.

5.3 Accurate Data Entry

You are responsible for the accuracy of data you enter. The App cannot verify that lab results or other information you enter is correct, complete, or properly attributed.

6. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SIERRANOVA LABS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OR RELIABILITY OF CONTENT.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SIERRANOVA LABS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL SIERRANOVA LABS' TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.

8. Indemnification

You agree to indemnify, defend, and hold harmless SierraNova Labs from and against any claims, liabilities, damages, losses, costs, or expenses arising out of your use of the App, your violation of these Terms, or any medical decisions you make based on information in the App.

9. Dispute Resolution and Arbitration

You and SierraNova Labs agree that any dispute will be resolved exclusively through binding individual arbitration, rather than in court. YOU AND SIERRANOVA LABS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION.

Arbitration will be conducted by JAMS under its Streamlined Arbitration Rules, held in California.

10. General Provisions

These Terms shall be governed by the laws of the State of California. These Terms constitute the entire agreement between you and SierraNova Labs regarding the App. If any provision is found unenforceable, the remaining provisions remain in effect. SierraNova Labs reserves the right to modify these Terms at any time.

11. Acknowledgment

BY USING LABSLEDGER, YOU ACKNOWLEDGE THAT you have read and understood these Terms, you are at least 18 years of age, you understand the App is not a medical device, you are responsible for backing up your data, and you agree to resolve disputes through binding arbitration.
